Terms of Service

This is the beta release of Melbourne AI POS. By signing up you accept these terms. Provisions may change with 30 days notice during beta. Final v1.0 will be reviewed by an Australian solicitor before public launch.
1. Who we are
Melbourne AI POS ("the service", "we", "us") is a self-service point-of-sale platform sold to Australian cafés and restaurants ("you", "the operator"). We are based in Melbourne, Victoria. Contact: melbourneaipos@gmail.com.
2. Subscription
- Pricing is AUD $49 per cafe per month (incl. GST).
- You start with a 30-day free trial. No card required to start. After 30 days you must subscribe to keep using the service.
- Billing is monthly via Stripe. Cancel any time from the Owner Dashboard — your cafe stays active until the end of the current billing period.
- Failed payments: we will retry up to 3 times over 7 days. If still unpaid, the cafe is suspended (data preserved) and we email you.
3. What you get
- Customer ordering screen (table QR codes), kitchen display, front-of-house view, owner dashboard.
- Multi-tenant data isolation — your cafe's data is separated from other operators.
- Updates and bug fixes during your active subscription.
- Email support at melbourneaipos@gmail.com (best-effort response within 1 business day).
4. Your responsibilities
- You must provide accurate cafe information (name, address, ABN if applicable).
- You are responsible for the content you upload (menu items, prices, photos, staff info).
- You must not upload illegal content, violate intellectual property, or attempt to access other operators' data.
- You are responsible for sharing the customer order link only with your own customers.
- You must comply with Australian consumer law and the Australian Privacy Act when handling customer data through the service.
5. Service availability
- We aim for 99% monthly uptime. The service runs on Google Firebase infrastructure (australia-southeast1, Sydney).
- Planned maintenance will be announced in advance where possible.
- We cannot guarantee uptime during third-party (Google, Stripe) outages.
6. Data ownership
- You own all the data you upload (menu, orders, customers).
- We may export your data at any time on request (email us).
- If you cancel, we keep your data for 90 days then permanently delete unless you ask earlier.

8. Liability
- The service is provided "as is" during beta. We are not liable for indirect or consequential damages (lost sales, lost goodwill).
- Maximum liability is capped at the amount you paid us in the previous 12 months.
- Nothing in these terms excludes rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).
9. Termination
- You can cancel any time from the Owner Dashboard.
- We can suspend or terminate accounts that breach these terms (illegal use, abuse of other operators, non-payment).
10. Changes
We may update these terms with 30 days email notice during beta, and 60 days notice after public launch. Continued use after the notice period means acceptance.
11. Governing law
These terms are governed by the laws of Victoria, Australia. Disputes will be heard in Victorian courts.
